Accomplished counselor helps you achieve your custody and visitation objectives

Child custody and visitation arrangements are often among the most contested aspects in any divorce proceeding. New York law specifies that decisions regarding custody and visitation should be based on the “best interests of the child.” Factors that can influence a finding of what is in the child’s best interests include the ability of each parent to provide care, including their physical and mental health, the parents’ work schedules, any history of domestic violence, and in certain circumstances, the wishes of the child. As an accomplished family law attorney, I will work to demonstrate that the child’s best interests align with your goals to help achieve arrangements that are right for your family. The types of custody available in New York are:

  • Physical custody — Also known as residential custody, physical custody refers to the child’s living arrangements, or which party bears responsibility for day-to-day care and supervision.
  • Legal custody — Legal custody refers to the authority to make important decisions about a child’s upbringing. For instance, the parent with legal custody would determine whether a child receives religious instruction or a certain type of medical care.

Parents often share equal legal custody while one parent may be given sole physical custody. In that case, an experienced family lawyer will work to ensure that the visitation rights of the noncustodial parent are respected by devising a visitation schedule that meets the needs of both parties.

Established attorney assists with child support payments

Following a breakup, both parents have the legal responsibility of supporting their children, whether those parents were married or not. In New York, child support amounts are calculated based on the state’s Child Support Standards Act, which was enacted to help ensure that children would maintain a standard of living similar to the one they enjoyed when their parents were together. This law establishes a support award based on a percentage of the parents’ income after adjustment for certain factors.

Decisions on child support and other family law issues will affect your life for years to come. It is important to be represented by an experienced attorney who understands you, your family, and your circumstances. The right legal professional can provide invaluable assistance that protects your rights now and in the future.
